HC warned judge who granted bail to Samrat

His bail cancelled, asked to surrender

Court Correspondent: The High Court has warned Judge Asifuzzaman Al Asad Mohammad of Dhaka Special Judge’s Court-6 in the case of granting bail to Ismail Hossain Chowdhury Samrat in a corruption case citing health reasons before the medical report came.
The HC said that without seeing the report, the judge granted bail to the medical ground and covered the car before the horse. The court warned the judge not to do such thing in future.
Wednesday (May 16) Justice Nazrul Islam Talukdar and Justice Kazi Mohammad, The High Court bench canceled the bail of the emperor. At the same time, the court ordered Samrat to surrender to the court within seven days.
Senior lawyer Mansurul Haque Chowdhury appeared for Samrat in the court. The state was represented by Attorney General AM Amin Uddin and Deputy Attorney General AKM Amin Uddin Manik. Advocate Khurshid Alam Khan appeared for the ACC.
Following the order, Advocate Khurshid Alam Khan said, “Ismail Chowdhury Samrat has been granted bail by the Judicial Court at the Medical Ground. But the rule is to call a medical report before giving bail, to hold a hearing of both parties, but in this case, he did not do so and gave bail by covering the car before the horse. In view of our statement, the High Court has canceled his bail considering the matter.
A hearing on the cancellation of the emperor’s bail was held on Tuesday. Following the hearing, the court set a date for the order. Earlier on Monday, the ACC filed an application in the High Court.
On May 11, Dhaka Special Judge Court-6 Judge AsifuzzamanAl Asad granted bail to Samrat on three conditions. On November 12, 2019, the deputy director Jahangir Alamof the ACC filed a case against the emperor on the charge of acquiring illegal assets worth Tk 2 crore 94 lakh 60 thousand 7. At the same time, he was ordered to surrender within seven days.

At that time, the High Court said in the court of law about the judge who had granted bail to Samrat.
Following the order, advocate Khurshid Alam Khan said the court had canceled the bail of Samrat citing health reasons before the medical report came.
Asked about the High Court’s comments on the judge, the ACC lawyer said the court had said that the judge had given bail to the medical ground without seeing the medical report. The court warned the judge not to do such thing in future.
Before getting bail in the case filed by the ACC, Samrat got bail in three more cases against him. Samrat was released from the prison cell of Bangabandhu Sheikh Mujib Medical University (BSSMU) on May 11 after being granted bail in all the four cases. He is still being treated at this hospital.
Samrat was granted bail on April 11 in a case filed under the Narcotics Control Act at Ramna police station. The bail was granted by the 7th Additional Metropolitan Sessions Judge’s Court in Dhaka. The day before, on April 10, he was granted bail by two separate courts in Dhaka in a money laundering and arms control case.
On October 8, 2019, the RAB arrested Samrat and his ally the then Juba League leader Enamul Haque alias Arman from Comilla. According to the RAB, Samrat and Arman were drunk at the time of arrest. They had foreign wine. For this reason, the mobile court sentenced them to six months imprisonment.
After the arrest, the emperor and Arman were brought to Dhaka from Comilla. After bringing him to Dhaka, the RAB accompanied Samrat to his Kakrail office. Wildlife skins, drugs and weapons were reportedly found in Samrat’s office. The mobile court sentenced Samrat to six months in prison for possessing wild animal skins.
Later, a case was filed against Samrat at Ramna police station under the Arms and Drugs Control Act. The Criminal Investigation Department (CID) of the police filed a case against him under the Money Laundering Act. The ACC filed a case alleging illegal acquisition of assets.
In the case filed by the ACC against the emperor on November 12, 2019, he was accused of acquiring known non-income assets worth Tk 2.94 crore.
After investigating the case, the ACC filed a chargesheet against Samrat on November 26, 2020. In the charge sheet, allegations were made against Samrat for acquiring non-income assets worth Tk 222 crore 8 lakh 72 thousand 493. The case is set to be heard on June 9.
